Welcome to Brothers Adventure Platforms (“the Game”), created and operated by HeCo Games. These Terms of Use & Conditions of Service (these “Terms”) govern your access to and use of the Game, our websites, and any related services (collectively, the “Services”). Please read them carefully. By downloading, installing, or otherwise using the Game or our Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Game or Services.

1. ACCEPTANCE OF TERMS

1.1 Eligibility. You must be at least 13 years old (or the minimum age in your jurisdiction) to use our Services. If you are under the required age, you may only use the Game under the supervision of a parent or legal guardian who agrees to these Terms.

1.2 Changes. We may modify these Terms at any time by posting revised Terms in the Game or at Terms of Use & Conditions of Service Your continued use of the Services after any changes means you accept the new Terms.

2. LICENSE GRANT & RESTRICTIONS

2.1 License Grant. Subject to your compliance with these Terms, HeCo Games grants you a limited, non‑exclusive, non‑transferable, revocable license to download, install, and play the Game on a mobile or desktop device that you own or control.

2.2 Restrictions. You may not:

• Reverse engineer, decompile, or otherwise attempt to derive the Game’s source code.

• Copy, rent, lease, distribute, sell, or create derivative works of the Game.

• Circumvent or disable any security or digital rights management features.

• Use cheats, bots, hacks, or automation to modify or interfere with gameplay.

• Remove or alter any trademark, logo, or copyright notice in the Game.

3. VIRTUAL CURRENCIES, PURCHASES & REFUNDS

3.1 Virtual Goods. The Game may offer in‑app purchases of virtual currencies (“Coins” and “Gems”) and digital goods (weapons, skins, power‑ups). These purchases are final and non‑refundable except as required by law or at our discretion.

3.2 Pricing & Billing. All prices are displayed in your local currency. Your purchase will be processed by the platform provider (e.g., Apple App Store, Google Play). You must comply with their terms.

3.3 No Real‑World Value. Virtual currencies and digital items have no cash value and cannot be redeemed for real currency. HeCo is not obligated to exchange virtual items for real money.

4. INTELLECTUAL PROPERTY

4.1 Ownership. The Game, Services, all related intellectual property rights, artwork, graphics, sound effects, musical compositions, and code are owned by HeCo Games or its licensors and are protected by copyright, trademark, and other laws.

4.2 Feedback. If you provide suggestions or feedback, you grant HeCo Games a perpetual, royalty‑free, worldwide license to use and incorporate them without obligation.

5. PRIVACY

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and share your personal information. By using our Services, you consent to the collection and use outlined therein.

8. DISPUTE RESOLUTION

8.1 Governing Law. These Terms will be governed by and construed in accordance with the laws of the State of Veracruz, Mexico without regard to conflict‑of‑law principles.

8.2 Arbitration. Any dispute arising under these Terms shall be resolved through binding arbitration before the Procuraduría Federal Del Consumidor (PROFECO) under its Consumer Arbitration Rules, except where prohibited by law. The arbitration will occur in Veracruz State, Mexico unless you and HeCo Games agree otherwise. You waive the right to a jury trial.

8.3 Small Claims. You may bring certain claims in small claims court in your county of residence if your claims qualify for small claims court and you file within the applicable statute of limitations.

9. DISCLAIMER OF WARRANTIES

THE GAME AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HeCo Games DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HeCo BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF OR INABILITY TO USE THE GAME OR SERVICES, EVEN IF HeCo Games HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

11. INDEMNIFICATION

You agree to indemnify and hold harmless HeCo Games, its affiliates, officers, directors, employees, and agents from any claim, demand, loss, or damages (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or your misuse of the Game or Services.

12. TERMINATION

HeCo Games may suspend or terminate your access to the Game and Services at any time, with or without notice, for conduct that HeCo, in its sole discretion, believes violates these Terms or is harmful to other users.

13. MISCELLANEOUS

13.1 Severability. If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force.
13.2 Waiver. No waiver of any term will be deemed a further or continuing waiver of such term or any other term.
13.3 Entire Agreement. These Terms, together with the Privacy Policy and any other legal notices published by HeCo Games, constitute the entire agreement between you and HeCo Games regarding the Game and Services.
